Administrative Provisions for the Presentation of Programs for Compliance with the Pollutants in Water Bodies Standard (NOM-001-SEMARNAT-2021)

In response to the State's obligation to ensure that everyone has access to, availability and sanitation of water for personal and domestic consumption in a sufficient, safe, acceptable and affordable manner; On December 5, 2022, the general administrative provisions for the presentation of the compliance programs established in the fourth transitory article of the Official Mexican Standard (NOM-001-SEMARNAT-2021)were published in the Official Gazette of the Federation (DOF), the observance of which is mandatory for those responsible for wastewater discharges in any type of receiving body owned by the nation, such as rivers, lakes, lagoons, seas, and the ground.

The purpose of the published provisions is to establish: the requirements, deadlines and procedures for the submission and voluntary registration of the Regulated Subject to the Programs for Compliance with NOM-001-SEMARNAT-2021; the procedure for the submission, registration and review of such programs, as well as the progress report that the regulated entity must submit; the compliance verifications carried out by the competent authorities and the penalties provided for in the applicable legal regulations for non-compliance with the commitments established in the Programs for Complianceas it is a voluntary programme.

It should be noted that the voluntary submission of the compliance programs may be made from the entry into force of NOM-001-SEMARNAT-2021 and until April 3, 2023.
